Rental Rates for Vacation Rental Villa in Davenport, Florida

Additional Information About Rental Rates:

General terms and conditions:

•  $250 deposit required to secure booking.  Deposit is non-refundable if you cancel.

• The total amount has to be paid 6 weeks before arrival.

• Failure to pay the balance by the due date will render the booking void with loss of deposit.

• Check in 4 p.m.  Check out 10 a.m. Early check-in or late check-out require prior approval.

• Cancellation charges:  More than 6 weeks before arrival: deposit only, 6 weeks or less: Full amount.

• Liability: The owners and the owner’s agents do not accept liability for personal injury accidents loss and damage to persons or personal effects howsoever caused.

• Occupancy:  Only those persons identified on the booking form are authorized to use the property.  Any changes to the persons booked to occupy the house must be notified for insurance reasons.

• Pets:  No pets allowed unless otherwise allowed for this villa.

• Smoking:  No smoking allowed inside the villa.

• Damages: Guest has to notify the owner or property manager for any loss or damage to the home or its contents during guest's stay.  Owner or property manager has the authority to inspect the property during guest's stay.

• Complaints: In the event of a complaint during your stay please contact the house management immediately. If the problem has not been reported, as requested to the Management Company, the owner cannot accept any responsibility. 

• Magical Orlando Resorts cannot be hold responsible for any payments made to any third party.  All    payments must be made to this company ONLY.

• Please notice that there might be extra charges for calling out the local management for additional services. These charges have to be paid locally.

• Pool: Because there are no lifeguards or other attendants at the swimming pool, tenants are expressly responsible for the safety of themselves, members of their families, and guests using swimming pool, and in so using or permitting to be used, specifically waive any and all liability claims. No tenant shall permit any juvenile member, elderly and persons with di

 

  disabilities of his family or guest to play in or around the swimming pool without providing an attendant who is able to swim and can protect such juvenile in case of difficulty in the water. Tenant is expected to conduct himself as a guest with reasonable decorum and violent games and exercises are not permitted.

   Disconnecting the pool alarms is against Florida law or removing pool fences, whichever has been provided for your home.

  The pool is inspected and cleaned on a regular basis. Please be aware that Florida is a tropical country and things can and will happen very quickly. Frogs insects etc. on occasions may enter the pool area and go for a swim especially after heavy rain fall. This situation is perfectly normal but obviously out of our control.  Simply remove the offending objects and dispose of same. Chemicals already in our pool will ensure it is always clean and safe for your use. Should something occur that you feel you cannot deal with, please contact management for advice ASAP.

• Pool heating. Please be aware of:

1. Pool heaters/exchangers need to run for at least 24 hours in order to produce heat.

2. Pool blankets when provided must be kept on when the pool is not in use especially overnight. If you do not use the pool blanket the pool drops off to the level of the air temperature and has to start from that temperature the next morning.

3. Heaters are heat exchangers and generate heat off the outside temperature, so if the outside temperature is70 degrees the pool will eventually get to 70 degrees over a period of 24-48 hours then it will increase by 1 degree per hour and if a pool blanket is supplied with the home this must be kept on to keep the temperature of the pool warmer than the air temperature.

4. Electric pool heaters / exchangers do not work when the outside temperature is below 50 degrees, the heater/exchanger will still be running but the compressor will not kick in until the air temperature goes above 50 degrees, so electric is still being used and no refunds will be given on this basis. If you feel that you want to have the pool turned off after reading this notice please call the office.

5. Pool heaters run on an 8 hour cycle

 

 

 

6. Guests are not permitted to touch the pool heater controls, any sign of tampering will result in the pool heat being turned off and the pool heat payment will be forfeited. Any problems with the pool should be reported to the house management immediately.

• BBQ: You have not been charged for the use of BBQ gas. There may however be some gas available to you at no cost which may have been left by previous guests. Should you require gas or run out of gas during your stay you will be required to obtain and purchase this yourself. The gas cylinder must be presented at the store for filling. (They exchange the empty cylinder with a full one.)

• BBQ cleaning.  If the villa has a BBQ, this has to be cleaned by the guest.

• Spa / Hot Tub, Deck and Patio:  Tenant hereby acknowledges that the property they have reserved includes a swimming pool/Jacuzzi (where applicable), patio and deck. The undersigned is fully aware that the surrounding areas can be dangerous and slippery when wet and that injury are likely to occur to anyone who is not careful. Tenants should observe and adhere to all rules and policies as posted at the property. With full knowledge of the above facts and warnings, the undersigned accepts and assumes all risks involved in or related to the pool, Jacuzzi, deck and patio areas.  No glassware is to be taken outside to the pool area.

• Blocked toilette: A blocked toilette is always an unpleasant experience. Florida sewerage systems are only designed to deal with human excreta and toilet tissue. Anything else can cause a major blockage. The flushing of sanitary napkins, baby wipes, diaper liners and disposable diapers are known to block sewers. A blocked drain will require the attention of a plumber and inconvenience your vacation while the obstruction is cleared.

• Trash:  Please follow the calendar and instruction for trash removal located in your villa. If you have any questions regarding pick up days please call the number for the management company in your villa.

• Utilities:  Unless otherwise noticed in this agreement, all utilities like electricity, gas, water, waste disposal, internet access (where applicable), cable, management fees, maintenance contracts, community charges, HOA charges, etc. are included in the Rental Fees and tenant shall not be required to pay any additional monies on any account. We ask that you are mindful and not wash your cars or use the towels to clean them.

• Because this is a private home with a private lease, there can be no credit given in case of early departure, and there is no subletting or assignment by tenant without prior written

 

   consent.  If all or part of the reservation is cancelled, all previously paid rent and deposit is forfeited unless the property can be re-rented for the same reserved time. However, if the property cannot be rented, all the above stated terms, no credit or return of rental fees or deposit will be made.

• Tenant's Personal Property: Tenant shall be solely responsible for any thefts, acts of vandalism, or other damage or loss of personal property which may occur during the course of this agreement, whether said damage or loss be the property of tenant or any other person invited in by the tenant, unless such damage is specifically caused by the negligence or incompetence of the owner or the owner's agents.

• Owner and owner’s agent commit to keeping the property in its normal, safe, usable and habitable condition.  In the event that the property is rendered unsafe, not usable or habitable by the local authorities and it is not caused by tenant’s actions, the tenant shall immediately be relieved of its obligations under this agreement.  He shall be refunded the unused portion of its rent. 

• In the event of failure of equipment to work, please notify the owner or property manager, and repairs will be made. Tenant, however expressly waives and relinquishes any rights or claims against the owner or agent or manager for any damage that may result to tenant from lack of maintenance, repair, or defect, including owner's or agent's or manager's ordinary negligence. All personal property of tenant kept on the premises is at the risk of the tenant. There will be no refund of all or part of the rental amount for any failure of any of the equipment to work. Only exception is the pool heating which would be refunded on a pro rata base. No refund can be made for inclement weather, water temps that are neither above 82 degrees nor for days when the pool was not in use. Please do not attempt to adjust the pool heating yourself as it is very easy to break it and very expensive to fix.

• No vans, trucks, motorcycles, boat trailers or recreational vehicles are permitted on the premises without special approval. Minivans are allowed.  Others must be kept parked at the clubhouse.

• Each party agrees to pay all costs incurred by other party in enforcing, by legal proceedings or otherwise, the terms of this lease and reasonable attorney's fees.

• Each party hereby knowingly, voluntarily and intentionally waives any right each party may have to a trial by jury with respect to any litigation arising out of, under, or in connection with this lease.

• In the event that the owner removes the property from the rental program or due to other   circumstances the house is not available then every effort will be made to find a similar property. Owner or agent should not be liable to tenant should similar units not become available, whereby monies paid shall be refunded.

• Utility/Cleaning. There is a standard move-out cleaning fee added/included to rent.  Our cleaning is mainly doing laundry, cleaning baths, vacuuming.   All kitchens must be left clean and orderly, no dirty dishes, ovens or stoves.  Please empty refrigerator.  Any unused or unopened item may be left behind.  Cleaning personal will clean out refrigerator and empty dishwasher.

• Under all circumstances, the Owner, the Management Company and their respective Agents joint and several liabilities is limited to the rental price paid.

 

 

Further Owners and/or Agent of Owners Terms & Conditions might be attached to this agreement and form an integral part of this agreement.

 

 

This rental agreement #XXXXXXXXX about home XXXXXXXXXXXX is between the owner and the Tenant. Magical Orlando Resorts is acting as a free agent and can't accept any responsibilities out of this document. The owner/manager is solely responsible for home licensing and taxes on payments made to him by Magical Orlando Resorts resulting out of this booking.
